Up 1 Digital · up1digital.ca
1.Introduction
This Privacy Policy explains how Up 1 Digital ("Up 1 Digital," "we," "us," or "our") collects, uses, discloses, and protects personal information in connection with our website at up1digital.ca and our early-access tools, starting with PostLingual (collectively, the "Services"). It applies to visitors to our website, individuals who contact us through our forms, and users who sign up for early access to our tools. By using the Services, you acknowledge the practices described in this policy.
2.What personal information we collect
We collect only the personal information you provide to us and a limited amount of technical information about your visit. Specifically:
- Contact form submissions: your name, email address, and company name, along with any message content you choose to include.
- Early-access signups: your email address.
- Website usage information (if and when analytics are enabled in the future): pages visited, referring URLs, browser and device type, operating system, approximate location derived from IP address, and similar standard analytics data.
3.How we collect it
We collect personal information in two ways: (a) directly from you, when you submit our contact form or an early-access signup form; and (b) automatically, through cookies and analytics tools, if and when such tools are enabled on the Services. Where analytics or other non-essential cookies are used, they will only load after you provide consent, as described in Section 9.
4.Why we collect it
We use personal information for the following purposes:
- To respond to inquiries and communications you send us.
- To provide early access to our tools and manage waitlists.
- To operate, maintain, secure, and improve the Services.
- To send product updates, announcements, and marketing communications, only where you have given consent to receive them.
- To comply with legal obligations and enforce our terms.
5.Legal basis for processing (EU/EEA and UK)
If you are located in the European Union, the European Economic Area, or the United Kingdom, we rely on the following legal bases under the General Data Protection Regulation (GDPR) and the UK GDPR:
- Consent for sending marketing communications and for setting non-essential cookies.
- Legitimate interests for responding to your inquiries, operating and securing the website, and improving the Services, where those interests are not overridden by your rights.
- Compliance with legal obligations where processing is required by law.
6.How we share information
We do not sell or rent your personal information to third parties. We share personal information only with service providers that process it on our behalf and under our instructions, and only to the extent necessary to provide the Services. These categories of service providers currently include:
- Cloud hosting and database provider that stores submissions from our contact and early-access forms.
- Email delivery provider used to send transactional messages, replies, and, where you have consented, product updates.
We may also disclose personal information where required by law, to protect our rights, or in connection with a corporate transaction such as a merger or acquisition, in which case we will take appropriate steps to preserve the confidentiality of your information.
7.International data transfers
Up 1 Digital is based in Canada, and the service providers we use may be located in Canada, the United States, or other jurisdictions. This means your personal information may be processed or stored outside your own country or region. Where such transfers occur, we take appropriate safeguards to protect your information, including using reputable providers with recognized data protection practices and, where applicable, contractual protections such as standard contractual clauses.
8.Data retention
We retain personal information only for as long as necessary to fulfill the purposes described in this policy, or until you request deletion, whichever is earlier. Specific retention periods: [FILL IN: specific retention period once decided]. When personal information is no longer needed, we securely delete or anonymize it.
9.Cookies
The Services may use cookies and similar technologies. Essential cookies necessary for the site to function may be set without consent. Non-essential cookies, including analytics and marketing cookies, will only be loaded after you provide consent through our cookie banner. For more details, see our separate Cookie Policy (if and when published).
